This Terms & Conditions Policy (“Terms of Use”) is provided for the benefit of customers and clients of Ethnus Consultancy Services Private Limited (“Ethnus”) as well as other consumers and parties who use Ethnus and/or its website(s), particularly codemithra.com (“Website”, “www.codemithra.com”, “Codemithra” or “Ethnus Codemithra”), “internmithra.com”, and/or applications (“Apps”) (collectively, “Ethnus Services” or “Ethnus Platform”).
Please read these Terms of Use carefully before using any of the diverse Ethnus Services. By visiting the Website, installing any of the Apps, and/or using any of the Ethnus Services, you shall have affirmed your agreement to these Terms of Use.

1. Definitions
“Learner/student/candidate/trainee” The individual who enrolls or registers for the course/program/training or training program offered by the Company from time to time.
“Consumer” means any individual or entity that uses any of the Ethnus Services. Where applicable, the term “Consumer” shall encompass all Ethnus Customers.
"Content" encompasses any video content created by or associated with any Ethnus Customer, accessible on and through Ethnus Services, including Profile Videos, Video Questions, Video Interviews, and Welcome Videos. Additionally, "Content" refers to all materials, whether publicly posted or privately transmitted, available on or through any of the Ethnus services.
“Software” means any necessary software used in connection with the Ethnus Services.
“Account” means an account associated with a Ethnus Customer who uses or has used Ethnus Services.
“External Content” means any Content excluding Customer Content and Video Content in which Ethnus does not participate.
“Ethnus Customer” means any person or entity who uses or has used Ethnus services.
“Ethnus services” means the suite of features, products, and services offered through Ethnus, its Apps, its App Services, the Website, and the Website Services.
“Ethnus Trademarks” means any trademarks, trade names, logos, and other commercial designs of Ethnus or licensed to Ethnus, whether or not formal registration exists including, but not limited to, “Ethnus”.
“Strategic Partners” means those trusted partners that Ethnus employs, engages, or retains to perform functions and/or provide services on its behalf.
“Website” means all of the content, information, and services (in any format whatsoever) accessible through the World Wide Web at the domain name codemithra.com.
“Website Services” means the services provided by Ethnus through the website at the domain name ethnus.com, codemithra.com, internmithra.com, and any of our other websites that may be used from time to time.
2. Pricing, Payments, and Billing
a. Registration Fee Paid /Installments Paid /Loan EMIs are non-refundable, non-transferable, and non-cancellable.
b. Once the Loan is availed, it can't be canceled at any time.
3. Training Program and Courseware
a. The learner will have access to applicable course content, labs, or hands-on exercises until the end date of training. Post completion of the training, these resources might not be available or might be available with limited usage.
b. Video recordings provided might be of pre-recorded sessions and may not be recordings of the live sessions attended by the learner.
c. In the case of courses provided by OEMs (AWS, Cyber Security, Salesforce, etc.), the video recordings of the sessions will not be available due to the content provider policies.
d. Requests for transfer to another batch or to rejoin a new batch after the end of the original batch will not be considered.
e. Training hours indicated will include the hours for live training as well as self-paced digital content.
f. Aptitude and Career Development sessions, if offered as part of the course, might be online/digital even if the learner has opted for an offline course.
g. In certain situations, batch dates and timings might be changed, or the batch might be combined with another batch. Prior notice will be provided in such instances.
h. An offline batch could be changed to online in exceptional situations beyond the control of Ethnus Codemithra (Eg: Outbreak of pandemic etc.)
i. The course content, including the topics, might be modified/changed depending on the current trends and industry requirements.
j. The training feedback provided by learners will be considered, and changes will be made if found relevant and necessary. Such changes will not include complying with the demand for a change in trainer.
k. Projects might not be a part of the course. If learners are interested in doing a project, problem statements can be provided. The project will have to be done independently by the learner.
4. Infrastructure and Requirements
The learner must possess the required infrastructure for attending the training program and when appearing for the certification exam, including the following:
A functioning laptop/computer with specifications as listed below:
a. Windows 10 or Mac OS 10.1 or later
b. 250GB SSD or higher and 8GB RAM or higher
c. 2.2GHz or faster, Intel or AMD processor
d. Firefox, Google Chrome (version 100 or later)
Additional requirements for online sessions:
a. Webcam or External Webcam - strongly recommended if your computer does not have an integrated or functioning webcam.
b. Headset/Headphones with Microphone - strongly recommended for optimal video conferencing/virtual learning, as the quality of sound is improved, and background noise is minimized.
Power backup for laptop/desktop, and internet modem/router.
A stable high-speed Wi-Fi connection obtained at home (preferred for the best study setting) or via a stable and uninterrupted 4G/5G mobile hotspot. Check the reference specifications to run video conferencing applications like Zoom and GoToWebinar and Zoho Meetings and Zoho Webinars
For offline training, laptops are to be carried to class when required to do so.
5. Expectations from The Learner
a. The learner should be punctual to training sessions and when answering assignments, assessments, and completing labs. In case of absence from any session, the learner needs to keep the mentor informed.
b. In case of absence from any session, the learner needs to keep the mentor informed.
c. The learner should follow online/offline classroom decorum
d. The learner should be courteous to faculty, fellow learners, and the Ethnus Codemithra support team. Any act of indiscipline or misconduct by a learner could lead to the removal of the learner from the program.
e. The learner should regularly fill in the trainer feedback form.
f. The learner should reach out to the mentor in case of any grievance.
g. The learner should take up the Global certification exam/s (OEM exams) within six weeks of training completion.
6. Placement Assistance
To be considered eligible for placements, the learner must:
a. Be above 18 years of age, holding a valid PAN and Aadhaar
b. Be above average in English communication
c. Have a minimum of 85% of overall attendance during the training program including live and self-paced digital sessions.
d. Clear all the tests including baseline, intermediate, and final assessment tests scoring more than 60% in each.
e. Complete all knowledge checks, labs, hands-on exercises, and/or practicals as outlined in the course. Additionally, any challenge labs or projects should be completed as per the course requirement or the trainer’s requirement. All of these should be done individually and not as part of a group.
f. Have cleared four rounds of mock assessment and two rounds of practice interviews (including Technical and HR rounds) as scheduled, with a minimum score of 60% in each.
g. Pass the applicable Global certification exam/s (OEM exams) by following all exam rules and regulations, and without engaging in any form of malpractice. “Malpractice could involve a deliberate or even unintentional act of wrongdoing, contrary to official examination rules, which could place a candidate at an unfair advantage or disadvantage, including leakage of any part of the exam, referring to question dumps, impersonation, falsifying information, external assistance, copying, collusion, forging of personal or external documentations, etc. Certain actions that an exam taker could do with or without intention could also be malpractice, which might have consequences such as getting barred from taking any further exams, revocation of any earned certificate(s), and anything else that the certifying organization sees as equitable.”
h. Ethnus Codemithra will provide placement support/money-back guarantee for at least 01 year from the date of completing Global certification / OEM certification.
7. Eligibility Criteria for Recruitment
The learner must ensure that they meet the eligibility criteria of the hiring company, as communicated from time to time, by the Ethnus Codemithra team.
The learner might not be considered for placement if
a. Found to have indulged in malpractice while taking up Global certification exam/s (OEM exams)
b. The furnished data is not accurate or is falsified.
c. Does not register for or does not attend three successive eligible placement drives.
d. Receives an offer letter from any recruiting organization - in this case, the learner has successfully completed the placement process and cannot attend any further placement drives.
e. The learner declines an offer or does not join the hiring company on the Date of Joining (DoJ)
8. Ethnus Services
Ethnus Services provides a comprehensive suite of offerings, covering career guidance, and versatile training solutions, both online and offline, catering to a diverse clientele that includes corporates, businesses, retail students, and universities. Additionally, their services encompass the facilitation of training programs, internships, and placement-related programs.
9. Content
"Content" encompasses any video content created by or associated with any Ethnus Customer, accessible on and through Ethnus Services, including Profile Videos, Video Questions, Video Interviews, and Welcome Videos. Additionally, "Content" refers to all materials, whether publicly posted or privately transmitted, available on or through any of the Ethnus Services.
10. Objectionable Content
Learners are expected to adhere to content etiquette when sharing any materials related to Ethnus in their assessment, assignments, emails, help desk tickets, or social media groups. They should also maintain decorum when exchanging information with their peers who are part of the Ethnus community. They must refrain from any misuse of content associated with Ethnus.
11. Copyright Infringement Policy
I. Ethical Use of Copyrighted Materials
All users are mandated to strictly adhere to ethical guidelines when utilizing any copyrighted materials affiliated with Ethnus. This includes assignments, email communications, and engagement within Ethnus-affiliated social media groups. Users must conduct themselves with professionalism and integrity, ensuring the sanctity of copyrighted content is preserved. Any act of misuse, misappropriation, or exploitation of Ethnus copyrighted materials is expressly forbidden and will be subject to stringent corrective measures.
II. Prohibition of Copyright Violations
Copyright infringement is defined as any unauthorized act that violates applicable copyright laws, whether conducted knowingly or inadvertently, potentially bestowing unfair advantages or disadvantages upon individuals. Such infringements include, but are not limited to:
a. Unauthorized reproduction, distribution, or dissemination of copyrighted materials.
b. Impersonation or misrepresentation related to copyright ownership.
c. Falsification or alteration of copyright documentation, whether of personal or external origin.
d. Collusion, copying, or seeking unauthorized external assistance in contravention of copyright laws.
Any conduct, irrespective of intention, that constitutes a breach of copyright regulations will invoke severe penalties. These penalties may encompass legal action, the immediate termination of access to Ethnus services, and any other punitive measures Ethnus deems necessary to vigorously protect its intellectual property rights and uphold the ethical standards of the Ethnus community.
12. Indemnification
This section outlines the user's obligation to indemnify us against legal claims and costs that may arise from their use of our services. It specifies the circumstances under which users may be required to cover legal expenses or damages, which safeguards our interests in the event of legal disputes.
a. Indemnification Obligation: You ("Indemnifying Party") agree to indemnify, defend, and hold harmless Ethnus, its affiliates, officers, directors, employees, agents, licensors, successors, and assigns (collectively, the "Indemnified Parties") from and against any and all claims, liabilities, damages, losses, costs, expenses, fees (including reasonable attorneys' fees and court costs) that such parties may incur as a result of or arising from (a) any information (including, without limitation, your Customer Content or any other content) you (or anyone using your account) submit, post, or transmit through Ethnus Services, (b) your (or anyone using your account) use of Ethnus Services, (c) your (or anyone using your account) violation of these Terms of Use, (d) your (or anyone using your account) violation of any rights of any other person or entity, or (e) any viruses, Trojan horses, worms, time bombs, cancelbots, or other similar harmful or deleterious programming routines input by you into Ethnus Services.
b. Scope of Indemnification: This indemnification obligation covers both liability and costs (including reasonable attorneys' fees) arising from (a) any and all breach(es) of your warranties outlined in these Terms of Use, (b) any infringement or misappropriation of any intellectual property rights, (c) any defamation, libel, slander, obscenity, pornography, or violation of the rights of privacy or publicity, or (d) any spamming, or any other offensive, harassing, or illegal conduct or violation of these Terms of Use.
c. Defense and Control: Ethnus reserves the right, at its own expense, to assume the exclusive defense and control of any matter for which you are required to indemnify Ethnus, and you agree to cooperate with Ethnus’s defense of these claims. You agree not to settle any matter without the prior written consent of Ethnus. Ethnus will use reasonable efforts to notify you of any such claim, action, or proceeding upon becoming aware of it.
d. Jurisdiction and Governing Law: This indemnification obligation shall be governed by and construed in accordance with the laws of the state of Karnataka, India, without giving effect to any principles of conflicts of law. You agree to submit to the jurisdiction of the courts located in Bangalore, Karnataka, for the resolution of all disputes arising from or related to these Terms of Use and/or your use of Ethnus Services.
e. Survival: This indemnification obligation shall survive the termination or expiration of these Terms of Use and your use of Ethnus Services.
13. Third-Party Links, Products, and Intellectual Property Rights
13.1. Third-Party Links
The Ethnus platform may feature links to third-party websites, services, advertisers, or other events not under Ethnus’s control. Ethnus does not endorse or assume responsibility for third-party sites, information, materials, products, or services. Accessing third-party websites from Ethnus is done at the user’s own risk, and Ethnus’s Terms of Service and Privacy Policy do not apply to such sites. Users release Ethnus from any liability arising from the use of any third-party website or service.
13.2. Third-Party Products
Ethnus may display or advertise third-party products or facilitate the purchase of such products. Interactions, promotions, or transactions with third parties, and any associated terms, conditions, warranties, or representations, are solely between the user and the third party. Ethnus is not responsible or liable for any loss or damage incurred from such dealings or the presence of third-party advertisers or products on its platform.
13.3. Intellectual Property Rights of Third Parties
Ethnus respects the intellectual property rights of third parties and expects the same from its users. The platform may contain material owned or licensed by third parties, protected by intellectual property rights and laws. Users agree to respect all copyright notices and restrictions in any content accessed through Ethnus and not to use, modify, copy, distribute, or create derivative works from such content without express permission from the rights holder.
Any unauthorized use of third-party copyrights or trademarks constitutes an infringement of the holder’s intellectual property rights and may result in civil and criminal penalties. Ethnus disclaims liability for any infringement of third party intellectual property rights due to user activities on the Ethnus platform.
By using Ethnus services, users acknowledge and accept that Ethnus is not liable for third-party products or services and that all risks related to the use or performance of such products, services, and links rest solely with the user.
14. Implicit agreement by users
Users of Ethnus services are expected to comply with and acknowledge the terms and conditions of the service as a natural consequence of using the platform. While they may not be required to provide formal, explicit agreement, their usage implies their consent to adhere to the established rules and policies of Ethnus Services.
15. The terms and conditions may be updated or modified without prior notice.
The terms and conditions are subject to change, and these changes may be made without advance notifications. This means that the terms and conditions of Ethnus services may be updated, revised, or modified at any time, and these changes can be implemented without the explicit provision of prior notice to users. It is advisable for users to regularly review the terms and conditions to stay informed about any updates or modifications.
